These Terms of Service ("Terms") are an agreement between you and SpectraNova LLC ("SpectraNova," "we," "us," or "our") and govern your use of spectranova.care and waitlist.spectranova.care (the "Site"), the NovaBright waitlist and Founders' Circle program, and any products you purchase from us. By using the Site or joining the waitlist, you agree to these Terms. If you do not agree, please do not use the Site.

Who can use the Site

You must be at least 18 years old and able to form a binding contract to use the Site, join the waitlist, or place an order. The Site is intended for users in the United States.

The waitlist and the Founders' Circle

Joining the waitlist is free and places no obligation on you to buy anything. Joining does not guarantee that a product will become available or that you will be able to purchase it.

The Founders' Circle is limited to the first 200 people who complete the waitlist signup. Founders' Circle members are eligible for founding pricing and the founder benefits we describe on the Site at the time you join. Once the first 200 spots are filled, the only way to join the Founders' Circle is through the referral path described on the Site, which currently requires referring five other people who also join the waitlist. We may change or end the Founders' Circle program, founder benefits, or the referral path at any time, and we will give notice of material changes where reasonable.

Referral fraud is prohibited. You may not refer yourself, create fake or duplicate accounts, or use bots or other automated or deceptive means to generate referrals. We may disqualify referrals, remove benefits, or close accounts that we reasonably believe violate these rules.

Pricing, subscriptions, billing, and auto-renewal

When you join the waitlist, there is no charge today and nothing is collected until your first month ships. Prices, discounts, and any founding rate are described on the Site and may change for future customers, except where we have committed to a locked founding rate for eligible Founders' Circle members.

NovaBright is offered as a monthly subscription. By starting a subscription, you authorize us and our billing providers to charge your payment method on a recurring monthly basis at the then-current price for your plan until you cancel. Your subscription automatically renews each month.

You can skip, pause, or cancel your subscription at any time through your account, with no penalty and no retention requirements. Cancellation takes effect at the end of your current billing period, and you will not be charged for the following period once you cancel. Taxes and shipping may apply and will be shown at checkout.

Refunds

If your first month is not right for your child, contact us within 30 days of delivery and we will refund that first month. If a shipment arrives damaged, defective, or incorrect, contact us and we will replace it at no charge. To request a refund or replacement, email hello@spectranova.care.

Important product information

NovaBright is a dietary supplement. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

NovaBright is intended to support a healthy oral microbiome. It is not a replacement for toothbrushing or for professional dental or medical care. We encourage continued brushing whenever possible. Talk to your pediatrician or dentist before starting any supplement, especially if your child has a medical condition, takes medication, or has a known sensitivity to probiotics or xylitol.

NovaBright contains xylitol. Xylitol is safe for people but is toxic to dogs. Keep NovaBright out of reach of pets, and contact your veterinarian immediately if your dog ingests any.

Individual results may vary. Product images, descriptions, ingredients, and availability may change, and we work to keep product information accurate but do not warrant that it is always complete or error-free.

Accounts

If you create an account, you are responsible for keeping your login information secure and for activity that happens under your account. Let us know promptly if you believe your account has been used without your permission.

Your content and feedback

The Founders' Circle invites members to share feedback on taste, texture, packaging, and future products. If you send us feedback, ideas, or suggestions, you grant SpectraNova a worldwide, royalty-free, perpetual license to use them without obligation or compensation, except for any public credit we choose to give. You are responsible for the content you submit, and you agree not to submit anything unlawful, infringing, or that you do not have the right to share. You agree to engage respectfully in any community we operate.

Intellectual property

The Site and its content, including text, graphics, logos, and the NovaBright and SpectraNova names and marks, are owned by SpectraNova LLC or its licensors and are protected by law. You may not copy, reproduce, or use them without our written permission.

Prohibited uses

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or harvesting data, uploading malicious code, or using the Site for any unlawful purpose.

Third-party services and links

The Site relies on and may link to third-party services. We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their own terms.

Disclaimer of warranties

The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, SpectraNova and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Site or our products. To the fullest extent permitted by law, our total liability for any claim relating to the Site or a product will not exceed the amount you paid to us for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless SpectraNova and its owners, employees, and partners from any claims, losses, and expenses, including reasonable legal fees, arising from your misuse of the Site or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Before filing any formal claim, you agree to first contact us at hello@spectranova.care so we can try to resolve the matter informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Nevada, and you consent to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the updated Terms.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them in connection with a business transfer. These Terms, together with our Privacy Policy, are the entire agreement between you and SpectraNova regarding the Site.
